It is understood that Puthiya Pathai De-addiction Centre reserves the right to refuse any service that is listed on the website and that doing so does not obligate the center to deliver any of the services listed.

Puthiya Pathai De-addiction Centre has consented to provide some services, which may only be considered after consulting with the client and after specific inquiries have been accepted by center personnel.

The term „Puthiya Pathai De-addiction Center‟ or „Puthiya Pathai‟ or „us‟ or „we‟ refer to the owners of this entity and this entity itself, as well as Employees, Contractors, Consultants and Associates (“Affiliates”) of Puthiya Pathai De-addiction Center, and the term „you‟, „your‟, „client‟, „resident‟, „Patient‟ or „user‟ refer to the person who avails the services of Puthiya Pathai De-addiction Center (and their guardian/ parent) or accesses the content on the website.

The terms "psychiatrist," "psychologist," and "therapist" shall have the meanings assigned to them by the Mental Healthcare Act, 2017 and the Rehabilitation Council of India Act, 1992, for the purposes of these Terms and Conditions.

The terms "nurse" and "medical officer" refer to individuals who are registered and governed by the Nursing Council of India Act, 1947, and the National Medical Commission Act, 2019 respectively.

(a) General Terms and Conditions

You must acknowledge the following terms shall regulate the relationship, restrict the extent and nature of services, as well as the quality and performance of services provided after a valid inquiry has been made and Puthiya Pathai De-addiction Centre has consented to provide services.

Puthiya Pathai De-addiction Center's obligation to deliver services shall be exclusively contingent upon the data submitted by the patient, client, or user, as well as the individual's treatment-related conditions. This honest revelation of all relevant information for Puthiya Pathai De-addiction Center's evaluation in order to determine the necessary services will be the only factor determining the nature and efficacy of the treatment.

After the aforementioned information is presented, Puthiya Pathai De-addiction Centre may, at its discretion, make an offer to you for either inpatient or outpatient treatment, including detoxification. These services allow clients to communicate with therapists or mental health experts directly through voice or video calls, and the information shared between them is kept private and used in compliance with applicable laws and the Privacy Policy. To use such a service, if it is offered, is up to the client's discretion.

Puthiya Pathai De-addiction Centre may record phone conversations, telecounselling sessions, in-person counselling sessions, and residential counselling sessions without the client/patient, parent, or guardian's consent.

You acknowledge that failure to provide consent that is not required by law will not affect your ability to use the services that are offered to you. But, it might have an impact on the level of some extra services that the client/patient, parent, or guardian would be able to use.

You understand and agree that any interactions and associated issues with other Clients including but not limited to your prevailing health issues and your experiences is strictly between you and the other Clients. You shall not hold Puthiya Pathai De-addiction Center or its Partners responsible for any such interactions and associated issues and Puthiya Pathai De-addiction Center will not be held responsible or liable for the same.

It is the user's or client/patient's responsibility to determine whether to seek medical assistance from a psychiatrist, counsellor, mental health specialist, or nurse who is not affiliated with Puthiya Pathai De-addiction Centre. When a user or client connects, engages, or transacts while using our services, Puthiya Pathai De-addiction Centre or its Partners shall not be held liable for any service disruption or violation by any outside mental health expert.

You recognize that confidential and delicate therapy is why you and other clients of Puthiya Pathai De-addiction Centre come to the facility. This means that you promise not to reveal any personally identifiable information on any other client or patient that may be present at Puthiya Pathai De-addiction Centre, either during or after your stay there.

(b) Without prejudice to the generality of the above, Puthiya Pathai De-addiction Center will not be liable for:

Medical Negligence: The client/patient or Parent/Guardian understands and acknowledges that Puthiya Pathai De-addiction Centre cannot be held responsible or liable for any guarantee of a full and complete recovery because of the fundamental nature of mental healthcare. If, after receiving treatment from Puthiya Pathai De-addiction Centre, you experience no improvement, insufficient improvement, a relapse, or a recurrence of any condition or symptom, for any reason, you will no longer be able to file claims of medical malpractice or negligence.

However, after using Puthiya Pathai De-addiction Center's services, neither Puthiya Pathai De-addiction Centre nor any of its affiliated experts, nor any authority or person connected to Puthiya Pathai De-addiction Centre shall be held liable or responsible if You neglect or fail to follow the advice and prescribed treatments, resulting in a relapse of the User's or Client's condition.

It should note that any changes to the scheduled appointment, whether made in advance or not, are going to extra cost fees. You will have the choice to accept the transfer and any alternate treatment that is offered, or to refuse it, should Puthiya Pathai De-addiction Centre recommend one of the following: inpatient, outpatient, or detoxification. Even though Puthiya Pathai De-addiction Centres strongly recommends a transfer, we cannot be held accountable for any negative effects that may arise from your rejection.

Any medical consequences that may arise following the use of the services of mental healthcare professionals, such as psychiatrists, physicians, psychologists, therapists, counsellors, nurses, and peer support specialists; as a result of giving insufficient details when scheduling an appointment or failing to disclose accurate information.

You are aware that Puthiya Pathai De-addiction Centre and its Affiliates solely provide mental healthcare and addiction treatment. Therefore, you will not have any claims against Puthiya Pathai De-addiction Centre in this regard, nor will you be obliged to follow any medical advice from the centre or its affiliates that is unrelated to the overall programme of mental healthcare that you are receiving. Puthiya Pathai Addiction Centre encourages client/patient comments and feedback.

The applicable law should be followed while providing any such input. As for the remarks or reviews made by any of the clients regarding the services they received, Puthiya Pathai De-addiction Centre will not be held accountable. Without providing a justification, Puthiya Pathai De-addiction Centre retains the right to delete any comments or feedback from the website. Puthiya Pathai Addiction Centre shall not be liable for any civil or criminal liability that may have existed prior to the client's admission or may arise in the future and give rise to legal action.

Danger to Client/ Staff/ Others If the client harms himself in any way, puts others in danger, attempts suicide, or actually commits suicide, and if these tendencies were either hidden from us or occurred for reasons other than our control, Puthiya Pathai De-addiction Centre and/or its affiliates will not be held accountable for such regrettable events. Please be aware that you will need to reveal any such inclinations the client/patient may have at the time of admission in order for us to take the necessary action.

Escape of Client Puthiya Pathai De-addiction Centre shall not be held liable for any criminal or civil obligations or consequences resulting from a client's escape from the facility. In agreement with the parent or guardian, the organisation will notify the police as soon as possible. Re- admission is an option for the parent or guardian, and the organisation handles it as an immediate discharge on the same day.

Accidental injury or Death Puthiya Pathai De-addiction Centre and its affiliates disclaim all liability for any criminal or civil damages that may result from the unintentional death of or injury to any user, client, or patient while they are using the services due to their own negligence. Puthiya Pathai De- addiction Centre will use the quickest method possible to notify the authorities in such a case after consulting with the parent or guardian. There is no basis for action against Puthiya Pathai De-addiction Centre for any unintentional damage or death unless there is egregious negligence towards a client that necessitates special supervision.

Puthiya Pathai Addiction Centre makes sure that their facilities are completely secure. On the other hand, Puthiya Pathai Addiction Centre disclaims any liability for any loss or damage to patients' or clients' personal property, including clothing and other contents.

(c) Emergencies, Investigations, Specialist Consultation and Hospitalization Staff members at Puthiya Pathai De-addiction Centre will schedule the specialized consultation, related fees, and investigations as directed by the treating doctor. These costs will be added to the client, parent, or guardian's monthly bill. In case of an emergency, the staff of Puthiya Pathai Addiction Centre will admit the patient/client to the closest private or government hospital and notify the parent/guardian, who will then need to come and take over the patient's care. If hospitalisation is necessary at any point and it is not an emergency, the parent/guardian will be notified and they should make arrangements for the hospitalization.

It shall be the responsibility of the parent/guardian to immediately further update themselves regarding the condition and treatment provided at the Hospital and Puthiya Pathai De-addiction Center staff will help parent/guardian with all necessary means in this regard. Medication administration must strictly follow the orders of the treating doctors at Puthiya Pathai De-addiction Centre or those of the consultant physician, psychiatrist, or specialist.

Discharge: Puthiya Pathai De-addiction Centre maintains the right to release a client before the Recovery Program's duration is up if the client; user, parent, or guardian refuses to cooperate with the treatment staff.

(d) Booking, Rescheduling and Cancellations of Admissions

Only payments in advance are accepted for our services, and there are no refunds for cancelled reservations.

Although Puthiya Pathai Addiction Centre will make every effort to guarantee a verified admission with an external mental health professional (such as a psychiatrist, psychologist, diagnostic centre, hospital, or another), for a client who has asked for an admission with us. Puthiya Pathai Addiction Centre disclaims all liability in the event that an external affiliate mental health professional (such as a psychiatrist, clinical psychologist, diagnostic centre, hospital, or others) cancels, delays, or reschedules an admission. In order to resolve any concerns, the client must speak with the relevant external affiliate directly.

In the event that the User, Client, or Patient cancels their appointment, fails to show to receive admission, or decides to leave the program in the middle, there will be no reimbursement. However, in the event of an emergency, the User, Client, or Patient may request a rescheduling of the admission or release. Puthiya Pathai De-addiction Centre may, at its sole discretion, approve such requests following a thorough evaluation. The decision in this regard is final and is contingent upon the availability of our healthcare and wellness specialists and their schedules.

PAYMENT FOR SERVICES

You can pay online for our services at Puthiya Pathai De-addiction Centre using a third- party payment platform. If you decide to pay online, you can be sent to a third-party payment gateway so that the money can be processed. The third-party payment gateway's terms and conditions and privacy policy will apply to this transaction. Puthiya Pathai De-addiction Center shall not be liable–

In the event that a transaction is unsuccessful or unlikely to be completed; or

In the event that the bank, credit card company, third-party website, or agency fails to fulfil any of its duties; or

In the event that any loss or damage results from the refusal or approval of a transaction, for any reason at all.

INDEMNIFICATION

Puthiya Pathai De-addiction Centre and its employees, contractors, consultants, and associates (collectively, the "Affiliates") consent to indemnify, defend, and hold harmless you from and against any losses, costs, damages, claims, and demands, including reasonable legal fees and other related costs and expenses, resulting from or arising out of:

your failure to provide correct and / or complete clinical information / history in timely and clinically appropriate manner; or

suppression of material facts; or

misinterpretation of the advice / prescription / diagnosis by you; or

Relapse or reoccurrence of Mental Illness once treated for reasons beyond Puthiya Pathai De- addiction Center‟s Control, or

failure to follow doctor‟s advice / prescription by you; or

your failure to comply with this Terms of the Services; or

Where any information you submit, or otherwise transmit to us violates third party rights or Applicable Laws.

We reserve the right, at our own cost, to take exclusive defence and command of any issue that would otherwise require your indemnification; in such event, you agree to fully assist us in mounting that defence and in raising any defences that may be available.

GENERAL These Terms of Service, unless otherwise noted, comprise the whole agreement between you/patient and Puthiya Pathai De-addiction Centre regarding the information provided herein and Services, and they take precedence over any prior written or verbal agreements, if any.

WAIVER Any provision of these Terms of Service that Puthiya Pathai De-addiction Centre waives will not be deemed to be a waiver of any other provision, whether similar, nor will it constitute a continuing waiver. Any waiver must be signed in writing and approved by a Puthiya Pathai De-addiction Centre official in order to be enforceable.

GOVERNING LAW AND JURISDCITION Without regard to issues of conflict of laws, the laws of India shall govern the interpretation and construction of these Terms. Any issues pertaining to or arising under these Terms shall only be decided by the courts located in Tamil Nadu, India.

THIRD PARTY SERVICE DEFICIENCIES Puthiya Pathai De-addiction Centre will work with outside providers of services to provide users, clients, and patients with the services they need. However, Puthiya Pathai De- addiction Centre will never be held accountable for problems arising from services provided by outside providers.

DISPUTE RESOLUTION AND ARBITRATION Any legal controversy or claim arising from or relating to this Agreement and/or our Service, excluding legal action taken by us to collect or recover damages in re: services offered by us, will be settled solely by binding arbitration. Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement shall be referred to arbitrator. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be Tamil Nadu. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English/Tamil language. The award shall be final and binding on the parties to the dispute.

Subject to the above Clauses, the courts at Tamil Nadu shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, your use of the Website or the Services or the information to which it gives access.
